These Terms and Conditions govern the sale of goods by Phoenix Wholesale & Distribution Ltd ("the Company") to its customers. By placing an order with us, you agree to be bound by these terms.
Phoenix Wholesale & Distribution Ltd is registered in England and Wales. Registered address: Unit4 Traynor Way, Whitehouse Business Park, Peterlee, SR8 2RU.
All orders are subject to acceptance by Phoenix Wholesale & Distribution Ltd. We reserve the right to refuse any order. An order is not accepted until we confirm it in writing or dispatch the goods.
It is your responsibility to ensure that the details of your order are correct. We cannot accept liability for errors in your order after goods have been dispatched.
All prices quoted are exclusive of VAT unless otherwise stated. VAT will be charged at the prevailing rate. Prices are subject to change without notice, although orders already accepted will be honoured at the quoted price.
Trade account customers will be charged at their agreed account pricing. Cash account customers will be charged at the prevailing retail or trade counter price.
Credit account customers: Payment is due within 30 days from the date of invoice unless otherwise agreed in writing. Late payments may incur interest charges in accordance with the Late Payment of Commercial Debts Act.
Cash account customers: Payment is required at the time of purchase or before dispatch of goods.
Delivery dates are estimates only and are not guaranteed. We will endeavour to deliver on the agreed date but shall not be liable for any loss arising from late delivery.
Risk of loss or damage to goods passes to the customer upon delivery. It is the customer's responsibility to check goods upon delivery and report any damage or shortages within 48 hours.
Goods may be returned within 14 days of delivery, provided they are in their original condition and packaging, and are unused. The following items cannot be returned:
A restocking charge of up to 20% may apply to returned goods. Please contact us before returning any items.
All goods carry the manufacturer's standard warranty. We do not provide any additional warranty beyond that of the manufacturer. Warranty claims should be directed to us in the first instance, and we will liaise with the manufacturer on your behalf.
Our liability for any claim arising from the supply of goods shall not exceed the purchase price of the goods in question. We shall not be liable for any indirect, consequential, or special losses.
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, fire, flood, strikes, supply chain disruptions, or government actions.
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
